Economy grew at a faster pace at end of 2011

WASHINGTON — The economy grew at a slightly faster pace in the final three months of last year, and Americans earned more income than previously reported. That could set the stage for stronger growth this year.

The Commerce Department said Wednesday that the economy expanded at a 3 percent annual rate in the October-December quarter — the fastest pace since the spring of 2010. It exceeded the previous estimate of 2.8 percent. And it was better than the third quarter’s 1.8 percent growth rate.

The growth estimate was revised up because consumers spent more than first thought, and businesses cut spending by much less. Imports rose by a smaller amount.

The report also showed that incomes rose in the second half of last year by more than previously estimated. Americans saved more, too.

Income growth is crucial. Economists have worried that recent gains in consumer spending weren’t sustainable without more pay. Higher incomes also make it easier for Americans to pare debts.

After taxes, inflation-adjusted incomes rose 1.4 percent in the fourth quarter. That’s nearly double the first estimate.

And in the third quarter, incomes rose 0.7 percent, compared with earlier estimates of a 1.9 percent drop.

The savings rate was also revised higher. Americans saved 4.5 percent of their incomes in the October-December quarter. That was down slightly from the third quarter. But it topped the previous 3.7 percent estimate for the fourth quarter.

Consumer spending rose 2.1 percent in the fourth quarter, powered by a jump in spending on autos and other long-lasting goods. That’s an improvement from the third quarter. And it’s much better than spending during the spring, when high gas prices nearly brought consumer spending to a standstill.

Most of the growth in the fourth quarter was driven by companies restocking their shelves. Many had cut their inventories over the summer, when they thought the economy was on the verge of a recession.

That didn’t happen. In fact, the economy has steadily improved since then. Still, companies likely scaled back the pace of their restocking at the start of the year to match the pace of consumer spending. That should slow growth in the current quarter.

Economists predict growth at an annual pace of 2 percent in the January-March quarter, according to a survey by the National Association of Business Economics. Growth will reach 2.4 percent for the full year, up from 2011’s increase of 1.7 percent, the survey found.

A host of recent data has made many analysts more optimistic about this year’s prospects. Companies have stepped up hiring, pushing the unemployment rate down for five straight months to 8.3 percent.

U.S. factories boosted output last month and December was their strongest month of growth in five years. Consumer confidence rose to its highest point in a year this month, the Conference Board reported Tuesday. That could signal Americans are ready to step up spending, which would fuel more growth. Consumer spending accounts for 70 percent of economic activity.

Some trends likely to slow growth in the current quarter are still good for consumers. The warm winter weather will likely mean Americans won’t have to spend as much to heat their homes. But that technically will lower the economy’s growth rate.

The economy was held back in the fourth quarter by a big drop in government defense spending. Defense spending is unlikely to be much of a factor in the current quarter, economists say.

Growth could be slowed or even derailed this year by rising gas prices, which have jumped 30 cents in the past month. That forces consumers to spend more for the same amount of gas and leaves less money for other purchases. A sharp rise in gas prices early last year choked off growth after companies began the year with a burst of hiring.

But so far, the increase isn’t enough to cause a repeat of last year’s disappointment, economists say. With hiring accelerating and incomes higher, consumers are better able to afford higher prices at the pump.

And the prices of other goods also jumped last year, particularly food, as well as other energy sources such as natural gas. But natural gas costs have plummeted recently while food prices are rising at a much slower pace. Those trends should offset some of the squeeze on spending from pricier gas.

The government makes three estimates of the gross domestic product for each quarter. The GDP is the economy’s total output of goods and services and includes everything from autos to utility output to haircuts. Each revision is based on more complete economic data.

Critics of Kazakh President Protest in Four Cities

ALMATY, Kazakhstan—Critics of the 22-year-old authoritarian rule of President Nursultan Nazarbayev staged protests in four cities Saturday and were met by overwhelming police forces but little violence, according to press and opposition reports.

It was the third set of demonstrations in three months, and each was met with a stronger response than the last.

In Almaty, the main city, rows of policemen armed with batons but no firearms hemmed in some 150 demonstrators, mostly elderly Kazakh men, on a narrow sidewalk, allowing them to make speeches but then arresting most of the speakers.

Hours earlier, police arrested Bulat Abilov and Amirzhan Kossanov, two leaders of the only legal opposition party, the Azat Social Democratic Party, at their office. They were taken to court, where a judge sentenced them to two weeks in jail for calling Saturday's demonstration in Almaty, at a demonstration last month.

"But I already served 18 days in jail for last month's demonstration" (as did Mr. Kossanov), Mr. Abilov, co-chairman of the Social Democratic Party, protested to the judge. Both said they were going on a hunger strike.

"This is totally illegal," said Zharmakhan Tuyakbay, a former parliament speaker and co-chairman of the Social Democratic Party, at the court hearing.

"The government is going to create their own Arab Spring by preventing ordinary people from exercising basic rights," added Baltash Tusumbayev, a former secretary of the country's National Security Council and a member of the opposition party.

Since the deaths of at least 17 demonstrators in the poverty-stricken Western town of Zhanaozen last December, the first major bloodshed in a quarter century, more than a dozen activists and journalists have been jailed and scores more are being formally investigated.

Reached by telephone in Zhanaozen, the wife one of the oilmen whose seven-month strike led to the violence said about 15 women held a protest to demand the release of their relatives. "The police called me in yesterday and told me that I'd get two weeks in jail if I went, but I went anyway," she said in a telephone interview.

Mike Brown, Metta World Peace appear at odds

For years, through showers of confetti and storms of boos, Jeanie Buss has always been in that seat, evolving into one of the most active, visible and trusted connections between Lakers management and the fans.

Which makes you wonder why, this season, she's barely been around.

Some longtime season-ticket holders say they have seen her at only a couple of games. When I call her this week, she says she's been to four.

That's four out of 14 home games, which is 29%, which is about what her Lakers are shooting from the three-point line.

When you're talking about the team's executive vice president for business operations, a high-profile executive for whom the Lakers are family, it's just plain weird.

''This year has been just different for me," she says.

Different for her, different on the court, different in the standings, and you wonder, if like many of us, Jeanie Buss just doesn't feel connected to this team.

The obvious change is that her boyfriend of a dozen years is no longer the head coach. She used to drive to every home game with Phil Jackson, sometimes even sitting with him in the stands during the D-League games in the late afternoons before taking her seat across from him at tipoff.

''When I go to the games now, I can't even drive in the carpool lane," she says, laughing.

Buss says that with Jackson now retired and living here, they are making up for all those nights they spent apart.

"I'm catching up on all the things I missed doing with my boyfriend for 12 years," she says. "He was always working, and he's not now, so I like to stay home and hang with him."

But there's obviously more here. Attending 10 more home games wouldn't seem to have a huge impact on hang time with a retiree. Buss' absence seems to be a statement that is less about her personal life and more about her basketball team.

Is she as befuddled by their approach as everyone else? Or, like many others, is she just plain bored?

"This year has been unusual … unique," she admits. "They should put a star next to it."

To understand Jeanie Buss' situation, one must first understand her position in the organization, where her father, Jerry, has essentially split the handling of the team's operations between her and her brother Jim.

Jeanie runs the business side, Jim runs the basketball side, yet Jeanie is a far more established presence because of her enduring connection with the community and deep understanding of what Lakers fans want. Although Jeanie has never made a basketball decision, she has long been the one to remind the basketball people what sells, and to push her father into sparing no expense in acquiring it.

Jeanie is the front-office personification of Showtime while Jim is, well, we really don't know what Jim is yet, do we? Right now, I guess, he's the guy who gave away Lamar Odom for nothing.

Wanted to Buy: MF Global Claims

Since MF Global Holdings Ltd. filed for bankruptcy protection last year, some customers of its failed brokerage have had little choice but to wait for the full return of their cash.

That is beginning to change. Lately, investors that gobble up claims in bankruptcy or other distressed situations have begun approaching former MF Global customers with offers to buy their claims for cash, at a discount.

The moves are similar to offers that emerged after the December 2008 disclosure that Bernard Madoff's investment-advisory firm was a Ponzi scheme. Speculators ranging from boutique investment firms to big banks have been transacting for claims of defrauded Madoff customers with the expectation that the trustee will be able to recover and return additional funds.

In the MF Global matter, the investment firms' offers are a bet that the trustee attempting to recover an estimated $1.6 billion in customer assets will find and return more—perhaps all—of the missing funds. Customers who choose to sell to these firms essentially relinquish their claim to the rest of their cash in exchange for money now.

Brokerage customers have already been reunited with 72% of the funds they lost access to at the time of MF Global's Oct. 31 bankruptcy filing. One firm, Triax Capital Advisors, based in New York, is offering to bring that figure to 88% in exchange for a customer's claim to the remainder of their funds.

Barrett Mikelberg, director of business development at Triax, said he has talked to between 60 and 80 customers of MF Global since late December about the possibility of buying their claims. He is targeting customers with larger claims totaling $1 million or more. None with claims that large have struck a deal yet, he said. But in the past week, a small number of customers with claims under $1 million have agreed to sell, he said.

"I'm willing to buy any claim," Mr. Mikelberg said. "I don't discriminate on size."

David Rosen, for one, isn't ready to deal. Co-owner of energy trading firm Rose Trading, he said he has been approached by multiple firms offering to buy his $50,000 claim. He is holding out. "I personally believe that at the end of the day the U.S. government, the CFTC [Commodity Futures Trading Commission] and the U.S. futures industry will not allow for a customer loss," he said.

The trustee liquidating MF Global's brokerage says on its website that it takes no view on whether customers should sell their claims.

Another firm, ASM Capital, said that in the past week it has begun mailing letters to customers with two different offers. The first offer is similar to Triax's: the remainder of a customer's claim for a discount. The second offer is for a smaller fraction of the customer's claim now, plus a stake in any additional payout from the trustee.

"We're trying to reach all customers, as many as possible," said Adam Moskowitz, chief executive of ASM Capital, based in Woodbury, N.Y. "This is part of what we do here on a regular basis."

Mr. Moskowitz declined to disclose how much he is offering customers. He said he is optimistic that additional money could be returned to customers partly because the trustee controls $1.4 billion that he is holding in reserve for matters such as litigation. "Whether or not all of that gets freed up to pay creditors is yet to be determined," Mr. Moskowitz said.

For both customers and the investors, the deal is a gamble. The trustee overseeing the liquidation, James Giddens, has said he has no further plans to return funds to customers in bulk; rather, claims from customers for the rest of their funds were due to the trustee by Jan. 31.

Mr. Giddens has said that he faces challenges in getting back the remaining funds. Last week, he said he has traced a majority of the cash transactions made by MF Global during its final week in October, when a shortfall in customer accounts began to emerge. But he also said retrieving that money could be difficult and will involve "very complex legal and factual determinations."

The Wall Street Journal reported last month that a "significant amount" of customer money could have "vaporized" in the chaotic final week before the firm's bankruptcy filing.

In the Madoff matter, the value of offers for claims has fluctuated widely, from as low as 20 cents to as much as 75 cents on the dollar. So far, Mr. Madoff's customers have received 6.5% of their principal back between distributions by trustee Irving Picard and the Securities Investor Protection Corp., a securities-industry group that provides insurance for bankrupt firms. That represents more than $1.1 billion of the $17.3 billion in potential claims.

Today, conservationists from the Huon Valley Environment Centre have released a sample of a celery top pine we believe to be more than 250 years old.

The sample was obtained from controversial Picton Valley logging coupe PC024B, where logging in high conservation value forest have been halted by conservationists this morning. Eight people have disrupted logging this morning, by setting up a tree sit.

The celery top pine is an example of the destruction being wrought upon all elements of the Picton Valley forest, whether or not Ta Ann takes every log.

The sample of the celery top pine clearly demonstrates that the forest currently being logged in the Picton Valley is part of an old growth ecosystem.

Furthermore, sections of the coupe were mapped as old growth forest during the Tasmanian Regional Forest Agreement process. This coupe is being logged to supply wood to Ta Ann, and their wood supply requirements are cited in official documents as the driver for logging this coupe which is inside the 430,000 hectares.
